Software Terms of Service

These supplemental terms concern the Swoosh Care websites, applications, dashboards, APIs, and other digital features. They do not replace an applicable signed service agreement, care agreement, privacy notice, or patient-rights notice.

Software provided as is

Except for express warranties and service commitments in an applicable written agreement, and to the maximum extent permitted by law, our software, websites, applications, APIs, and digital features are provided "AS IS" and "AS AVAILABLE." We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to that extent. We do not guarantee uninterrupted or error-free operation or any particular result. Nothing in this clause limits rights or remedies that cannot lawfully be excluded, our obligations under applicable privacy or security law, or our express contractual commitments.

Healthcare and legal rights remain protected

This disclaimer applies only to software and digital features. It does not waive patient rights, professional standards of care, provider duties, mandatory reporting, Medicaid or EVV requirements, or obligations under a business associate agreement. It does not change which legal organization provides care or holds a patient record.

Arizona and Nevada services, provider identities, records, authorizations, and contracts remain separate. This software clause does not transfer responsibilities between NV Care Solutions Inc., Arizona Family Care Network Inc., Absolutely Able, or any other participating organization.

Existing agreements

Express warranties and service commitments in your applicable written agreement control over this software disclaimer. Where applicable law does not permit an exclusion, that exclusion does not apply to you.

Marketplace terms apply only to engagements governed by those terms; they do not convert provider-delivered or Medicaid care into a private marketplace engagement.
